The ShadowDocket, the Supreme Court's Procedural Future?
The Supreme Court's ShadowDocket is being increasingly used in the service of this activist court. It began as a process specifically for death penalty appeal so you had cases where someone was going to be killed on thursday and if the supreme court spends months deciding whether or not it's legal to execute them, the case will be moot because the person will be dead. The solicitor general would only ask the supreme court to decide a shadow docket case may be less than once a term like it was considered an extraordinary act even make the request.
