The Bill of Rights and Enumerating Rights
In theory, you should have the exact same distinction of incorporated and unincorporated unenumerated rights. The concern was, can we enumerate all the rights that people have? And so threw in the ninth amendment, which sort of says, look, everything it happens before, is not the complete list of all the rights of human beings. A then the tenth amendment comes in, andi note, it talks about powers, powers. But both of these two provisions were we're trying to say there's more power here for states than the constiute specifies.
