You would expect the court otherwise, in cases that are not emergencies, you know, don't involve fundamental rights. And a cynic would say that the reason why the supreme court is doing more of these cases and ruling the way they are is because it's the shadow docket,. So its the court is able to do significant damage to civil rights and civil liberties without there being the kind of full scale reporting that there is when the court hears argument and decides a major case. The Supreme Court has increased the number of decisions it makes in the so called shadow docket.
