The Problems With the Reasonable Expectation of Privacy Test

The court has to decide that that your subjective expectation of privacy is one that society would deem to be reasonable. Now you at first that principle led to only minimal observations that were out in public places. And now it's gone even beyond that, at least what's a fly over it's just a few seconds here. It's literal constant monitoring of one's home.
