Is the State Trial Court in Texas Moot?
The college does not have nearly the same kind of religious pervasive sectarian character, but the college does. That's an intentional decision and that's partly based on where people are at different stages and the way the graduate schools function. So what do you think about the corporation as a whole, that turns out to be very tricky. You would think under a Supreme Court decision called Murdoch versus Memphis, the Supreme Court doesn't have jurisdiction to reverse state courts on questions of state law. Now there is a really interesting law review article arguing that was wrong.
