The Liberal Justices' Concerns About Separation of Powers
Harold Crant of the Chicago Kent College of Law: The issue here is that when a special prosecutor is appointed to look into whether or not an individual violated a court order, that is simply not a case where there should be a special prosecutor. He says it may well be that other justices are not as eager to whittle away judicial power because taking away the ability to appoint a special prosecutor does undermine some of the authority judges have wielded in the past.
