You have to stay in the green with both of those things because YouTube will very clearly skim through what you can and cannot do. I think a good guide for this are the kind of news compilation channels. You're reproducing somebody else's thing in a different format. So fair use doesn't cover everything, having a fair use disclaimer is not enough if you're really just re uploading 10 minutes of somebody else's content. If you choose wrong, it's like taxes. And your channel can suffer the consequences of that. Are the laws antiquated? Absolutely. Are they going to continue to change? Absolutely. It's going to be very interesting to see how they go.
