The Supreme Court's Decision in TWA Versus Hardison

Congress did not define undue hardship in the Civil Rights Act. TWA versus Hardison was before the Supreme Court, the issue that was in play was actually the regulations from the EEOC and not the amended statute. Justice Thomas starts off rather quickly by asking, well, what we just described isn't this wasn’t the statute really not in play during TWA versus hardest. And so therefore, statutory, sorry, decisive, we would not come into play.
