Is the 9th Amendment Really a Rule of Recognition?
In some ways, that criteria is one of the bedrock rules of recognition. The use in question is not, I think, primarily for heart, the individual citizens obeying the rules. So even though the Constitution is supposed to be our foundational document, right now it looks like the 9th Amendment as we'll talk more about.
