FEC makes three different arguments. They failed to itemize how that $250,000 was repaid to establish standing. What Ted Cruz has to show is that the committee used post-election contributions to repay that first $250k. If any amount of that $250K came from pre-election contributions, remember, the first issue that's at play here is the cap on post-election donations.
