The First Amendment and the Incitement Prong

There's a whole constitutional issue about whether that works. But it certainly will fuel the argument that if you combine it with my first point, that this is being done for political purposes. And I really do not think that is what Jack Smith is thinking that he is bringing this to stop someone from running from office. That's just not how prosecutors think. They think, you know, did you commit a crime? Is it appropriate to charge this person? Other people? Does it meet the elements? Have other people been certainly situated?
