Ripple and the SEC's New Guidance on ETH
The Hinman documents were not a bombshell for the XRP case for the ripple case. I think they could be useful background for the case to show the unfairness of the action itself but they won't factor into it. The doctrinal analysis in the case ripples got a good fighting chance on fair notice the how we stuff is a lot harder and if they're willing to go the distance I think the Supreme Court's willing to reshape administrative law and enforcement under administrative law with the major questions doctrine so I think they've got a shot either at scotus or changing the law itself.
