The US Copyright Office will assume that the interviewer and the interviewee own the copyright in their respective questions and responses. But there is case law that goes the other way, presuming that the party who records it owns the recording unless otherwise specified. A former federal prosecutor named Mitchell Epner says he spoke to a current trademark lawyer at the firm Rothenburg, Whitman, Rich PC. He said while certain aspects of the latest lawsuit are ridiculous, including the place where it's filed, the fundamental claim that Donnell Trump holds a copyright interest in his answers was actually a respectable decision.
