Is It Critical to Own a Brand?

The name is critical, even for a start up. There's no point building up associations and recognition to a name that you don't own. As long as you've got something unique, then i would protect it,. But it depends on the aspirations. If they haven't got big aspirations, then probably not worth it. You know, with a colour, if you choose well and you do the right things, you might be able to end up trade marking that colour. So it as a choice that matters there. Is more for the designer to understand the legal what would be involved to secure trade mark protection.
