Is the Original OGL 1.0 a Good Idea?
The original OGL gave wizards the right to cancel content that was offensive or sexist or racist. That is nowhere in the original OGL. The test here as an IP lawyer is likelihood of customer confusion. And absolutely it is substantially similar, large likelihood of consumer confusion and large potential,. I think, to potentially damage the brand.
