Is the Pari Passu Clause a Typo?
The pari passu clause that nobody understands, says, the bonds rank and will rank. It seems like they altered the language to suggest that it just applies at one point of time. What does that mean? Exactly like it seems like the implication would be that the government could subordinate some investors at a later date. The question for a court will be, do we read it as the bond jest saying they ranked equally at the time of issue, which makes the whole pari pass clause gibberish,. Because the whole point of the clause is that it protects you against future misbehaviour by the sovereign rank. And it also doesn't make sense wen they have events of default
