Originalism and Starry Decisis
This week's white paper is called originalism and starry decisis. It was written by a mikoni barrett, who used to be a law professor at Notre Dame before being appointed to the supreme court. She argues that there are precedents out there that may not comport with what an originalist judge would like to do. The opinion upholding social security is on her list of potentially vulnerable decisions so like everyone loses their old age pension or money not backed by gold standard.
