Chief Justice Roberts wrote in his year-end report on the judiciary, "The Supreme Court has never considered the question of whether Congress actually has the power to impose these rules" The justices have been filing these things every year and they sign a page that says something about if you falsify this, there's civil and criminal penalties. So I don't know what to make of that because if my view was that it was unconstitutional, I think I would just not file it.
