Is There a Retroactive Effect to This Decision?
The court is not in favor of retroactively applying rulings. For people who've already been sentenced and their cases are already under way, it's going to come down to a somewhat tricky procedurea mechanism. Some people might be able to benefit from this, some might not, depending on how far along they are in the process. But at the very least,going forward, people who are in the type of situation that wouldn't are in in all the circuits now can take advantage of this rule.
