The President Biden Case and the Pence Case
The DOJ declined prosecution in the Pence case because there was no evidence of intent to withhold classified material. The FBI conducted a thorough search and didn't find any other documents that were classified. A sitting president cannot be indicted while they are president, which is controversial but founded on some good intentions. So by indicting him, you're essentially depriving the American people of the full services of their elected president as he defends himself in court.
