The Confusion at the Supreme Court on the Rogers Test

There seems to be a lot of confusion at the court on this. And I think it reflects the new makeup of the court. Three justices by my count did not ask a single question, and that was Justice Barrett, Justice Kavanaugh, and the Chief Justice. They are all textualists. The Rogers Test is an exception to illegal activity, and it does not have any textual basis.
