The Independent State Legislator Theory
The supreme court decided to hear a case in its next term called more versus harper. It opens up this question of what's called the independent state legislature theory. The idea that when the constitution says in its election clause, te the times, places and manner of holding elections for senators and representatives shall be prescribed in each state by the legislature. That is not how the supreme court has previously interpreted the elections cause.
