Mata vs. Avianca: A Personal Injury Case in New York
The plaintiff was bumped with like drinks card or something while on Avianca flight 670 from El Salvador to JFK airport in New York several years ago. Mata hired a lawyer named Stephen Schwartz of the firm Levidow Levidow and Overman who filed in state court in New York two and a half years later. But as it turns out, injuries on international flights are subject to a treaty called the Montreal Convention. An article 35 of that treaty says that you have to bring your claims within two years.
