The Trial Penalty - It's Not My Idea

The trial penalty is known among us defence lawyers as the Trial Penalty. Back in the day, when i first started, there wasn't much of a penalty for someone exercising ter right to trial, as opposed to pleading guilty. Prosecutors back then, at least in the federal system, took no position sentencing there. Their view was, sentencing is up to the court. They're there to present the facts, then the court decides on sentence. Over the last really, 30 years, since 19 87, senator kennedy introduced legislation to create the united states sentencing commission with the hope that that would equalize sentencing across the united States. But what it in fact did was made the system draconian.
