Rob: The courts have been trying to grapple with, what does course of employment mean? And as part of that is they've recognized that an employee can mean different things to different men and for different purposes. Rob: I think the recent supreme court case shows us that that isn't quite correct. What you're saying rob is whether a person was classified as an employee for the purposes of employment legislation or for tax purposes, was likely to be influenced by completely different policy considerations than those that justified the imposition of vicarious liability.
