The PCMA and the POCSO Act
The POCSO Act is a legislation that was enacted to tackle sexual offenses against children. It defines children as all persons underneath the age of 18 years. The PCMA currently sets the legal age of marriage at 18 years for girls and 21 years for boys. If two minors in a marriage have sexual intercourse with each other, it would amount to an aggravated form of penetrative sexual intercourse which invites higher penalty than a regular penetrativeSexual intercourse charged with inviting.
