Justice Douglas DeSense wrote that trees and fish should have standing to sue for their own preservation. Justice McEwen was a quick writer who had this poetic lyrical component. Judge Sutton: There is room for this approach in the states, but you have to admit it was outside against the current when it comes to federal law at the time.
