What Is the Dormant Commerce Clause?
The purpose of the Commerce Clause was to do away with barriers that states had erected to sort of inhibit trade. The Dormant Commerce Clause is essentially a judge made addition to the Commerce Clause, says CNN's John Sutter. Even though Congress isn't directly regulating interstate commerce, it still has power to prevent states from regulating marketplace or doing anything that would burden interstate commerce.
