The Taking's Clause of the US Constitution
The chicken farmer's protection was grounded in the Fifth Amendment of the US Constitution. The Supreme Court ruled it said by flying their planes in this manner the United States had effectively confiscated Cosby's property and according to the Fifth Amendment he was due just compensation.
