Do You Expand Dickerson or Shrink Dickerson?
Kagan: The question here was sort of like, do you expand dickerson or shrink it a? Dickerson is where the federal government passes a statue to try to overrule miranda. And so her point is if it can't be taken away by congress, how is that not a rightrivile or immunity protected by the constitution? Kagan: i think it does come down to that prudential question of simply not wanting to extend 19 83 any further.
