In Medo-Thin case, FTC said it would look at objective evidence, not subjective evidence. But the court said that type of testimony by meta executives was less probative than what they wrote down two months before proposed acquisition. The agency has done over time in consent orders to identify 60 to 100 potential competition or potential competition like challenges against Google and Facebook.
