Trademark law protects consumers from being duped into buying goods or services under the mistaken assumption that they are being offered by someone other than the person actually offering. In every trademark infringement case, it is necessary for the plaintiff to establish what we call consumer confusion. And most courts say that's in the range of 10 to 20 percent of the consumers, depending on the type of good or service.
