Is There Going to Be a History and Tradition Test?
Bruin was a case involving the right to bear arms and which I completely agreed with. What was really the most interesting part of Bruin was the test. Is there going to be strict scrutiny or intermediate scrutiny? There's some Chesterton's fence, Sarah, about levels of scrutiny that I think we're beginning to see the wisdom.
