The FTC hasn't done a really good job of going out there and stopping that, but I have seen people get themselves into trouble. And certainly if they're taken to the NAD, they get called out for that because you have to substantiate any claim that you make about your final product. The shortcut for indie brands, especially as they start out and they have this fly under the radar mentality is well, somebody tested the raw material. So it must be true about my final product. They'll put those, whatever they've gotten from the fact sheet and imply and implied claims are just you're just as guilty with implied claims as you all with overt claims.
