Is This a Strict Liability Offence?
Nobody from the restaurant saw this. It only took a minute. But who else are you going to suey? That says, our number one criterion is rendering the plaintiff hol and so even if it's not a great fit, we're going to find a way to make sure the plaintiff gets recompensed for her injuries. If that were the case, you would have strict liability on the offences. Negligence is not a strict liability offence.
