The Supreme Court of the United States Finds That the Independent State Theory Has No Legs
The North Carolina state Supreme Court has flipped 5-2 to the Republicans, who have promptly overruled the case. In an opinion by Chief Justice Roberts, the Supreme Court finds that the so-called independent state, the legislative theory, has no legs. The court says it has already repeatedly considered earlier challenges in which some flavors of this theory have been tender to the court.
