Terence Ross: The court with its new makeup seems to be unable to approach intellectual property cases without using a raft of examples, many of which are sort of ludicrous and really don't advance the ball much. Justice Alina Kagan said she didn't get it when asked if parody was good enough for trademark infringement. "I would go so far as to describe this as merely soft boric humor," he says.
