Jessica Gonzalez sues the state under title 42 section 1983 of the United States Code statute that allows individuals to sue the states for civil rights violations. Simon Gonzalez drives to the police station and opens fire on the building at the police with a gun that he purchased earlier that evening. The court throughout this opinion is constantly referring to whether or not she has a property interest in the restraining order, but you can sort of ignore those semantics. In this opinion, Antonin Scalia holds that Gonzalez was not entitled to the enforcement of the restraining order.
