The Future of Injunctions

In Germany, assuming that there's been no preliminary finding on validity, if there's a finding of infringement is an issuance of an injunction automatic essentially. In the usual case when an injunction is found or when infringement is found is an injunction automatic. So it's a relief as of right. But there has been a change to the statute effective last year that had a long history. And so when extraordinary circumstances are present, which would result in a disproportionate hardship for the defendant, then the court can consider has discretion to either not enter into an injunction or to maybe have a grace period or something of the sort. As I understand, could you get an injunction? Here the injunction is still the rule
