In any case where an algorithm is being used, say, instead of a human, using an algorithm that has bias doesn't mean that there wasn't already bias in the human. I think part of what is dangerous about using automated decision systems for really high stakes problems like this is the lack of an ability to query how is the algorithm performing? For example, is the algorithm more accurate on certain groups than the algorithm is on other groups? It's very difficult to query that. But you're absolutely right that the same question should be asked of humans who are executing these decisions in the absence of algorithms.
