Why Didn't Norfolk Southern Label These Rail Cars as Highly Hazardous?

Norfolk Southern put up around $1.5 million upfront to support affected families, fund rescue equipment and air purifiers. The limited threshold requirement of the regulation that oversees hazardous materials in the freight industry was such that the company wasn't required to label the rail cars as being highly hazardous. There was no regulation that they had to adhere to.
