Is There a Line of Distinction Between Search Results and Rankings?
Petitioners suggested that somehow you could distinguish between search results, which would be protected even under their theory where certain recommendations would not be protected. I think it becomes very hard to distinguish that from a ranking based on your past preferences, likes, dislikes, etc. And so when we think about heaping liability on these sorts of recommender systems, those are exactly the kinds of outputs or lack of output that we'll get with greater liability.
