There was a case called Abigail Alliance in the DC Circuit where people that were terminally ill with cancer had exhausted all possible therapies and medications. They said there's an unapproved drug that's going through FDA approval process that might save them. But they challenged in court, the FDA's withholding of that drug, and they were told by the DC Circuit. Nope, that's an unen enumerated right
