The murder trust tried to get insurance for Mike Malloy, the night watchman at a funeral home. They were rejected by Metropolitan Life Insurance Company because they didn't have an unrelated man on their list of potential insureds. Pasquen decided to modify the plan so that he and Mike's names could be used as part of the application process. He also pulled in Red Murphy who was now known as Nicholas Mallory. The two men would use fake names getting around the fact that Pasquen's and Mike's name were now known to the local insurance companies. But not yet: Marino wanted to find a way to make more money from the plot.
