If SpaceX builds a city on Mars, it would be treated as a research station under the current law. The rules are that you can't prevent other people from using your research station. There's no kind of rules about harvesting resources at scale or profiting off them. Any consequences for violating law would fall onto SpaceX as a company that operates in the United States.
