The FTC's New Guidelines for Online Disclosure
The FTC raised the maximum civil penalty for each violation of the provisions it enforces from 250,000 to 46,000. The agency stated that tagging a brand in a post or using hashtags like hashtag sponsored or hashtag ad doesn't qualify as proper disclosure if it isn't clearly visible to all users. That means creators on TikTok can't include such disclosures only in the text of a post but must feature them within the video itself.
