I would say things are more vulnerable than they were. The reason that these were 14th Amendment cases, although the Harvard one was actually a civil rights act case sort of originally. You're not going to find strict scrutiny or rational basis or intermediate scrutiny or any of the stuff in the Constitution. These are judicial inventions. There's no recognition of the fact that this is fundamentally enormously complicated.
