The Effects of Injunctions on Indigenous Peoples

The reason why corporations can get them so handily is partly because of the way that harm is defined. Injunctions started to become more prevalent and more successful for corporations and governments exactly at a time when Indigenous people started to win constitutional recognition, says Anne Spice. The courts are undermining all of that jurisprudence and court and and case law around Aboriginal rights and title um and just determining Aboriginal rights based on whether you know they constitute a reparable harm or balance of convenience which are injunction tests.
