In 2003, Anthony Kennedy joined the liberals in striking down a Texas anti sodomy law as unconstitutional. That case now I think is very much in the sights of at least some members of the Supreme Court and the conservative legal movement writ large. The real framework for that is just something conservatives are not 100% on board with. They'll talk about how sexual orientation shouldn't be a quote unquote suspect classification but then turn around and justify discriminating against people based on sexual orientation. Because hey, they've always, you know, there is this history and tradition of true gay people like trash. because this is a day of Christian country.
