There are a lot of social mechanisms that lead to rules getting established. Even in the case of edict, there can be people enforcing them even if they aren't written down. So you don't need to centrally organize system of punishments. You can have what Hart calls it as this diffused hostile or critical reaction. And then it's at the point where we start to systematize that that we could start to talk about law.
